Welcome to Unstuck. These Terms of Service ("Terms") govern your access to and use of the Unstuck mobile application ("App"), website, and all related services (collectively, the "Service") provided by AFOM Solutions Pvt Ltd, operating under the brand name Unstuck ("we," "us," or "our"). By downloading, installing, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

Please read these Terms carefully before using the App. These Terms constitute a legally binding agreement between you and AFOM Solutions Pvt Ltd (operating as Unstuck).

1. Acceptance of Terms

By creating an account, accessing, or using the Service, you confirm that:

  • You have read, understood, and agree to be bound by these Terms and our Privacy Policy.
  • You are at least 13 years of age. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you confirm that your parent or legal guardian has reviewed and agrees to these Terms on your behalf.
  • If you are using the Service on behalf of an organization, you have authority to bind that organization to these Terms.

We reserve the right to update or modify these Terms at any time. We will notify you of material changes through the App or by email. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.

2. Description of the Service

Unstuck is an anxiety and panic support application designed to provide self-help tools and educational resources. The Service includes:

  • Guided Audio Sessions: A library of 94+ guided audio sessions covering anxiety management, panic attack support, intrusive thoughts, and relaxation techniques.
  • Daily Journal: A personal journaling tool for tracking your mental health, moods, and progress.
  • Exposure Therapy Logging: Tools to plan, track, and reflect on exposure therapy exercises.
  • 7-Day Challenges: Structured challenge programs to build resilience and coping skills.
  • SOS Mode: Quick-access tools for managing acute anxiety or panic episodes.
  • Playlists: Curated collections of audio sessions organized by topic and need.
  • Offline Downloads: The ability to download audio content for offline listening.

3. Important Medical Disclaimer

UNSTUCK IS NOT A MEDICAL DEVICE, DOES NOT PROVIDE MEDICAL ADVICE, AND IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.

The Service is designed solely as a self-help and educational tool. It does not provide therapy, counseling, psychiatric services, or any form of clinical treatment. The content available through the Service, including guided audio sessions, journal prompts, and exposure therapy logging tools, is for informational and educational purposes only.

You should not rely on the Service as a replacement for consultation with a qualified healthcare professional. Always seek the advice of your physician, psychologist, psychiatrist, or other qualified mental health provider with any questions you may have regarding a medical or psychological condition.

If you are experiencing a mental health crisis, suicidal thoughts, or a medical emergency, please immediately contact your local emergency services (such as 911 in the United States), go to your nearest emergency room, or contact a crisis helpline such as the 988 Suicide and Crisis Lifeline (call or text 988 in the US).

By using the Service, you acknowledge and agree that:

  • The Service does not create a therapist-patient, doctor-patient, or any other clinical relationship between you and Unstuck.
  • No content within the Service constitutes a professional diagnosis or treatment plan.
  • Results from using the Service may vary and are not guaranteed.
  • You are solely responsible for your health decisions and for seeking professional help when needed.

4. Account Registration and Security

4.1 Account Creation

To access certain features of the Service, you must create an account. You may register using:

  • Phone number with one-time password (OTP) verification
  • Google Sign-In
  • Facebook Login
  • Sign in with Apple

You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us at hello@unstuckforlife.com if you become aware of any unauthorized use of your account or any other breach of security.

4.3 Account Termination by You

You may delete your account at any time through the App settings or by contacting us at hello@unstuckforlife.com. Upon account deletion, your personal data will be handled in accordance with our Privacy Policy.

5. Free and Paid Services

5.1 Free Tier

Unstuck offers a free tier that includes:

  • Full access to the entire library of guided audio sessions (94+ sessions)
  • Up to 10 free journal entries
  • Access to SOS mode, playlists, and 7-day challenges
  • Offline downloads of audio content

5.2 Paid Subscription (Unstuck Premium)

The premium subscription unlocks additional features, including:

  • Unlimited journal entries
  • Full access to exposure therapy logging tools
  • Personalized evaluations and insights

Premium is available through auto-renewable in-app subscriptions. Subscription options and pricing are displayed within the App prior to purchase.

6. Subscription Terms, Billing, and Cancellation

6.1 Auto-Renewable Subscriptions

Unstuck Premium is offered as an auto-renewable subscription. When you purchase a subscription:

  • Payment is charged to your Apple ID account or Google Play account at confirmation of purchase.
  • Your subscription automatically renews unless auto-renewal is turned off at least 24 hours before the end of the current billing period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current billing period at the rate of the selected plan.
  • You can manage and cancel your subscription at any time through your device's subscription settings (Apple App Store or Google Play Store).

6.2 Free Trials

We may offer free trial periods for the premium subscription. If you do not cancel before the free trial ends, your subscription will automatically begin and you will be charged the applicable subscription fee. Any unused portion of a free trial period will be forfeited when you purchase a subscription.

6.3 Cancellation

You may cancel your subscription at any time:

  • On iOS: Go to Settings > [Your Name] > Subscriptions > Unstuck > Cancel Subscription. Alternatively, open the App Store, tap your profile icon, tap Subscriptions, select Unstuck, and tap Cancel.
  • On Android: Open Google Play Store > Menu > Subscriptions > Unstuck > Cancel Subscription.

Cancellation takes effect at the end of the current billing period. You will continue to have access to premium features until the end of the period you have already paid for. No partial refunds are provided for the remaining days of an active subscription period.

6.4 Refunds

Apple App Store: All purchases made through the Apple App Store are subject to Apple's refund policies. To request a refund for an App Store purchase, visit reportaproblem.apple.com or contact Apple Support.

Google Play Store: All purchases made through Google Play are subject to Google Play's refund policy. You may request a refund through Google Play within the timeframes specified in Google's refund policy. Visit Google Play's refund page for details.

Unstuck does not directly process payments or issue refunds for subscription purchases made through the App Store or Google Play Store. All billing inquiries should be directed to the respective platform.

6.5 Price Changes

We reserve the right to change subscription prices. Any price changes will take effect for subsequent billing periods after notice is provided through the App or via email. Existing subscribers will be notified in advance, and continued use of the subscription after the price change takes effect constitutes acceptance of the new price.

7. User Content and Data Ownership

7.1 Your Content

You retain full ownership of all content you create within the Service, including but not limited to:

  • Journal entries and notes
  • Exposure therapy logs and records
  • Personal notes and reflections

By using the Service, you grant Unstuck a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing and improving the Service. We will not sell, share, or use your personal content for advertising purposes.

7.2 Content Responsibility

You are solely responsible for the content you create within the Service. While the Service is a private journaling and self-help tool, you agree not to use it to store or transmit any content that is unlawful, harmful, threatening, or otherwise objectionable.

7.3 Data Portability

You may request a copy of your personal data and user-generated content at any time by contacting us at hello@unstuckforlife.com. We will provide your data in a commonly used, machine-readable format within a reasonable timeframe.

8. Intellectual Property Rights

8.1 Our Content

All content provided through the Service, including but not limited to guided audio sessions, text, graphics, logos, icons, images, audio clips, interface designs, and software, is the property of Unstuck or its licensors and is protected by copyright, trademark, and other intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use, subject to these Terms. This license does not include the right to:

  • Copy, reproduce, distribute, or publicly display any audio content from the Service
  • Share, resell, sublicense, or make available any part of the Service to third parties
  • Download audio content for any purpose other than personal offline listening within the App
  • Modify, adapt, translate, or create derivative works based on the Service
  • Use any data mining, robots, or similar data gathering methods

9. Prohibited Uses

You agree not to engage in any of the following prohibited activities:

  • Unauthorized Distribution: Sharing, uploading, broadcasting, or distributing any audio content, guided sessions, or other proprietary materials from the Service to any third party or platform.
  • Reverse Engineering: Decompiling, disassembling, reverse engineering, or attempting to derive the source code of the App or any part of the Service.
  • Circumvention: Attempting to bypass, disable, or interfere with any security features, digital rights management, or access controls of the Service.
  • Impersonation: Misrepresenting your identity, age, or affiliation with any person or entity.
  • Interference: Interfering with or disrupting the integrity or performance of the Service, its servers, or connected networks.
  • Automated Access: Using bots, scrapers, or automated tools to access, collect data from, or interact with the Service without our written consent.
  • Commercial Use: Using any content from the Service for commercial purposes, including in therapeutic practice, training, or resale, without our prior written authorization.
  • Abuse: Using the Service to harass, abuse, or harm others, or to promote violence, discrimination, or illegal activities.

Violation of these prohibitions may result in immediate termination of your account and access to the Service, and may subject you to legal liability.

10. Age Requirements

The Service is intended for users who are at least 13 years of age. By using the Service, you represent and warrant that you are at least 13 years old. If you are under 13, you may not use the Service under any circumstances.

If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms. Parents and legal guardians are responsible for monitoring their minor children's use of the Service.

We do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will take steps to delete such information promptly. If you believe we may have collected information from a child under 13, please contact us at hello@unstuckforlife.com.

11. Privacy

Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the practices described in the Privacy Policy.

12. Third-Party Services and Links

The Service may integrate with or contain links to third-party services, including:

  • Authentication providers (Google, Facebook/Meta, Apple)
  • Payment processors (Apple App Store, Google Play Store)
  • Analytics and performance monitoring services

Your use of third-party services is governed by their respective terms and privacy policies. We are not responsible for the content, privacy practices, or availability of third-party services. We encourage you to review the terms and privacy policies of any third-party services you access through the App.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Without limiting the foregoing, Unstuck does not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free.
  • The results obtained from using the Service will be accurate, reliable, or meet your expectations.
  • Any errors in the Service will be corrected.
  • The Service will be compatible with all devices or operating systems.
  • The audio content, journal tools, or exposure therapy features will produce any specific therapeutic outcome or improvement in your mental health condition.

You acknowledge that the use of the Service is entirely at your own risk. We strongly recommend that you use the Service as a complement to, and not a replacement for, professional mental health care.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL UNSTUCK, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

  • Your access to, use of, or inability to access or use the Service.
  • Any content obtained from the Service, including audio sessions, journal features, or exposure therapy tools.
  • Any decisions or actions you take based on information or content provided through the Service.
  • Unauthorized access to or alteration of your data or content.
  • Any third-party conduct or content on or related to the Service.
  • Any health outcomes, mental health changes, or lack thereof resulting from use of the Service.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO UNSTUCK IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the fullest extent permitted by law.

15. Indemnification

You agree to indemnify, defend, and hold harmless Unstuck and its officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your use or misuse of the Service.
  • Your violation of these Terms.
  • Your violation of any applicable law or regulation.
  • Your violation of any third-party rights, including intellectual property rights.
  • Any content you create or transmit through the Service.

16. Termination

16.1 Termination by You

You may stop using the Service and delete your account at any time. If you have an active subscription, please cancel it before deleting your account to avoid future charges.

16.2 Termination by Us

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause and with or without notice, including but not limited to cases where:

  • You violate these Terms or any applicable law.
  • You engage in prohibited uses as described in Section 9.
  • We reasonably believe your actions may cause legal liability for you, other users, or Unstuck.
  • We discontinue or materially modify the Service.

16.3 Effects of Termination

Upon termination of your account:

  • Your right to access and use the Service will immediately cease.
  • We may delete your account data in accordance with our Privacy Policy.
  • Any outstanding payment obligations and the provisions of these Terms that by their nature should survive termination (including Sections 7, 8, 13, 14, 15, and 18) shall survive.

17. Changes to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. This includes adding or removing features, changing the content library, modifying the user interface, or updating system requirements. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

18. Governing Law and Dispute Resolution

18.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Where local consumer protection laws provide you with mandatory rights that cannot be waived, nothing in these Terms is intended to limit those rights.

18.2 Dispute Resolution

In the event of any dispute arising out of or relating to these Terms or the Service, you agree to first attempt to resolve the dispute informally by contacting us at hello@unstuckforlife.com. We will make reasonable efforts to resolve the dispute within 30 days.

If the dispute cannot be resolved informally, you and AFOM Solutions Pvt Ltd agree to submit to the exclusive jurisdiction of the courts in 16-9-417/A/1, Near Water Tank, Opposite R J Function Hall Old Malakpet, Hyderabad, Telangana 500036, India, subject to any mandatory consumer protection provisions that may apply in your jurisdiction of residence.

18.3 Class Action Waiver

To the extent permitted by applicable law, you and Unstuck agree that any proceedings to resolve disputes will be conducted on an individual basis and not as a class action, collective action, or representative action. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against Unstuck.

19. General Provisions

19.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Unstuck regarding the Service and supersede all prior agreements, understandings, and communications, whether written or oral.

19.2 Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

19.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Unstuck.

19.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

19.5 Force Majeure

Unstuck shall not be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to natural disasters, acts of government, internet or telecommunications failures, power outages, or pandemics.

19.6 Notices

We may send you notices through the App, via email, or by posting updates on our website. You may send notices to us at hello@unstuckforlife.com.

20. Apple App Store Additional Terms

If you downloaded the App from the Apple App Store, the following additional terms apply:

  • These Terms are between you and Unstuck, not Apple Inc. ("Apple"). Apple is not responsible for the App or its content.
  • Apple has no obligation to provide maintenance or support services for the App.
  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App.
  • Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession and use of the App, including: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.
  • In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Unstuck, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
  • You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

21. Google Play Store Additional Terms

If you downloaded the App from the Google Play Store, the following additional terms apply:

  • These Terms are between you and Unstuck, not Google LLC ("Google"). Google is not responsible for the App or its content.
  • Your use of the App is also subject to the Google Play Store Terms of Service.
  • Google is a third-party beneficiary of these Terms and may enforce them accordingly.
  • Refunds for purchases made through Google Play are subject to Google Play's refund policy.

22. Facebook/Meta Platform Terms

If you use Facebook Login to access the Service, the following additional terms apply:

  • Your use of Facebook Login is subject to Meta's Terms of Service and Data Policy.
  • Unstuck accesses only the minimum information necessary for account creation and authentication (such as your name and email address associated with your Facebook account).
  • You may revoke Unstuck's access to your Facebook account at any time through your Facebook Settings under Apps and Websites.
  • Unstuck does not post to your Facebook profile, access your friends list, or collect any data beyond what is required for authentication.
